[NEWS] T-ara barred from using mobile phones

With the Korean music industry still reeling from the TVXQ vs SM Entertainment lawsuit, there was news today that new girl group, T-ara have been barred from using their own mobile phones by their company recently.

T-ara expressed on the 10th, "After discussions with our company (Mnet Media), we have voluntarily handed in our mobile phones to them. If there's any urgent matter, we will borrow our manager's mobile phone." With mobile phones very much an essential part of a young girl's lifestyle, is the management company going too far with this action?

With regards to this, their manager said, "Not just their mobile phones, we are also restricting their time on the internet. We felt that malicious postings against them on the internet will affect their daily training." He added, "More than 80% of the comments posted by netizens are hateful remarks towards individual members. These hateful remarks does nothing useful, and will just make them feel depressed, etc. So we decided on this after consultation with all the members and got their consent."

Weeks before their debut, T-ara would hand over their mobile phones when they wake up at 6am. It will then be returned to them once training is over at night. But the company felt that text messaging by the members were affecting their sleep time, so they decided to raise the bar and take away their mobile phones for a period of time instead.

Their manager ended by saying, "This is nothing new. Others like Lee Seung Gi and F.T Island also didn't have mobile phones when they just debuted. Not just Tara, it's the same with many idol groups. There are of course some instances where certain members would secretly use their mobile phone without the company's notice. This is where I and the innocent members would start "hunting" them down."

[NEWS] SM Entertainment explains about DBSK issues

dbsk1

I’m sure a lot of fans may be outraged at SM Entertainment for the seemingly unfair payment DBSK has been perceived to have been receiving, but SME recently made an announcement that the boys are actually getting 4:6 (40% DBSK / 60% SME) of the profits. During the last 5 years, DBSK has earned about 49.8 billion won which is equal to a bit more than 40 million USD. From this amount, 22.4 billion won (a bit more than 18 million USD) was subtracted for the expenses SME invested in the group. From the remaining 27.4 billion won (a bit more than 22 million USD), the profits were divided 4:6.

SME stated “Right now the profits are split DBSK 40%, SM 60%. From the 27.4 billion won, 10.1 billion won (almost 9 million USD) goes to DBSK and 16.4 billion won (a bit more than 13 million USD) goes to SME.” Furthermore, it was mentioned that for overseas activities, DBSK earned 70% of the profits while SME made 30%. This included all events, festivities, and commercials.

However, members Junsu, Yoochun, and Jaejoong said “The calculations of the profits are too vague. We cannot trust it.

SME also explained the reasoning behind the 13 year contract with DBSK. They stated “We were taking overseas activities into consideration when we were making the contract. We were thinking about 3~4 years in Korea, 3~4 years in Japan, and 3~4 years in China.

This is the same episode that girl group 2NE1 will . Aside from 2PM and 2NE1, F.T. Island will make an appearance in the episode as well. It is unknown whether 2PM member Junsu will take part in the cameo since rumor has it that the poor boy was sick.

Other than Chansung, who was part of the High Kick cast, the 2PM boys don’t seem to have much acting experience. It’ll be interesting to see how this “gag group” will do with their cameo, so watch out for the release of the episode!

[TRANS] DBSK'S LAWYER STATEMENT FOR FANS

translate:

As said by DBSK's Lawyer:
I apologized,
Right now, the news reported weren't what I had said, they (reporters) would be spreading 100 sentences when I had merely said one.
5 of them really wanted to be together, and they had never thought of living with only three persons.
To be letting the fans worry, I felt very guilty, and I hope that all of you can encourage them more.
sang-hyeok im (Lawyer's name)

No need to worry girls, things are starting to look much brighter! Earlier reports were looking bad in terms of the relationship between TVXQ and SM Entertainment, SM Entertainment has however released an official statement about the current issue.

SM Entertainment stated, "TVXQ is a band that represents Asia, they must absolutely continue actitivies. The cosmetics company issue, will be resolved."

One of Asia’s biggest group Dong Bang Shin Ki, has 3 of its members in a possible lawsuit against their own company SM Entertainment.

Dong Bang Shin Ki members Xiah JunSu, Micky YooChun and Hero JaeJoong had gone to Seoul Central District Court to hand in an application for provisional disposition to terminate all effects of their exclusive belonging rights contract with SM on 31st July.

It has been known that their reasons for doing so is that the contract with SM Entertainment has many irrelevant conditions attached. It is also known that the content to the contract the 3 members cannot agree to includes having them belonging exclusively to SM Entertainment for 13 years and also unhappiness over profit allocation.

The lawyer responsible for this case said, “We are currently preparing for a lawsuit against SM for this contract. (About the reasons to why) We cannot reveal the details now.”

There has also been saying that the 3 members have differing views to SM on their upcoming ‘Dong Bang Shin Ki cosmetic enterprise expansion’.

Currently out of the 3 members, JunSu is already doing a cosmetic business with his parents. It is said that there were plans for the company to operate a cosmetic business, with sheep placenta as the main ingredient, using the group’s name as the brand name in Seoul GangNam and GyeongGiDo IlSan. It is said that there were also plans for the business to be launched in China bringing in hundreds millions KRW in profit.

But it has been said that the 2 sides are having some differing views and also complications arose through their discussion on how the product and brand will go.

Follow up #1:
What will happen to the 3 members’ activities scheduled for Dong Bang Shin Ki? there is the upcoming SMTown Live 09 on 16th August. It seems that the members may not be appearing for the concert with their lawsuit with the company.

Especially with all the rumours lately about ‘disbanding of Dong Bang Shin Ki’. To add on, one of the 3 members’ parents have also established their won entertainment company in China.

Fans are also very taken back by this incident. Many have voiced their disbeliefs on various discussion forums.

Follow up #2:
One of the Korean new media No Cut News has known through phone call from SM that SM said, “We are aware that some of the (DBSK) members have some disagreements with the company, but we do not know that they have sparked a lawsuit wth the company. The director board of the company is currently having an urgent meeting in an undisclosed place in Seoul to discuss about their countermeasures.

They also added, “We will have our official stand asap”.

Follow up #3:
SM Entertainment has released their official stand on the case.

They said on 1st August morning, “It is true that Xiah, Hero and Micky made the application for provisional disposition to terminate the exclusive rights effects from their contract on 31st July at the district court. With that the company is very taken back by the action, we are trying to get confirm all the truth from them currently. “

They continued, “But as a representative group to the country and to Asia, our stand is that activities for Dong Bang Shin Ki have to continue even with this disposition application. And about the problems arising from the discussion to do a cosmetic entreprise, we plan to talk over them and sort out the problems as soon as possible.”

It has been know that members YunHo and ChangMin has decided not to take part in this lawsuit. Both of them are currently preparing for their drama debut this September and year-end.

Quote:Just to clarify:
The 3 members are applying to retract the the exclusive rights effects from their contract with SM
There are also other problems like differing views and problems in developing their cosmetic entreprise
Disbanding is a speculation on the Korean news side because the 3 members will not be able to continue on their activities since they are on the case

Woo Young Hypnotized Without Consent

The August 1st episode of Star King, as part of its summer special, used hypnosis to show “the best studying method.” 2PM member Wooyoung was on the show and was chosen from the panel to be hypnotized. Fans who attended the show’s filming later commented that even though Wooyoung showed objection to the idea of being hypnotized, filming continued anyway. Hypnosis was still performed on him, upsetting many fans who later complained on the show’s online boards.

Angry fans responded with comments like “Hypnotizing somebody without their consent is the same as attacking them,” and “Do celebrities not have rights?”

In the clip above, the hypnosis activities start at around 1:18. While the hypnosis was being done, Wooyoung expressed that he was scared and that it felt like someone was holding up his arm. Watching this segment made me feel extremely uneasy, especially starting at 2:55 when he suddenly lost his balance and fell over before fellow group member Nichkhun rushed over to catch him. Wooyoung commented after the show that he had trouble speaking during the ordeal.

[NEWS] What’s AVEX’s Contract?

It has been confirmed that three members of TVXQ, YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, have filed for a Exclusive Contract Validity Suspension and Provisional Disposition Request against SM Entertainment and have also filed for a Preservation of Evidence Request.

Avex

The Preservation of Evidence Request refers to, “Any account books, contracts, receipts, transfer slips or any other documents that will aid in calculating the exact income and expenditure of the requester,” and this was done to calculate the exact amount of money TVXQ earns.

There is more controversey to come as a statement was released that the members of TVXQ, till now, have never received information about the contents of their Japanese contract.

In 2005, TVXQ signed a contract with Avex Entertainment, one of the largest agencies in Japan, through SM Entertainment and have been working with both entertainment agencies ever since.

However, till now, the members of TVXQ have no idea what kind of contract the two agencies formed, and how their income is being divided in Japan.

A representative of the law firm that is helping the three members had a phone conversation with this reporter and stated, “Ever since TVXQ started their activities in Japan, they have never been given any information about how their income is divided or what their contract consists of.”

He also said, “We have tried numerous times to tell the agencies that what they are doing is unlawful and tried to convince them to show TVXQ the contract, but both agencies have been ignoring us,” and “The members have been diligently working for this company without even knowing exactly what kind of contract they are under.”

The Sejong law firm lawyer who is in charge of this lawsuit informed reporters in an interview of the problems regarding unfair division of income and complete honesty with the members and also stated that “We have not discarded the notion of filing for compensation later on.”

Avex Entertainment, who is in charge of all of TVXQ’s Japanese activities, wrote on their ofiicial website on August 1st and stated that TVXQ will continue on with their activities regardless of the current lawsuit.

[INFO] JaeChunSu’s Official Statement

Idol group Dong Bang Shin Ki’s members Micky YooChun, Hero JaeJoong and Xiah JunSu finally revealed their stand about their problems with SM Entertainment.

DBSK

Their representative revealed through news media on 3rd August, “The 5 years period after they debuted, the 3 of them felt that their minds and their bodies are tired having to follow the tight schedule that the company put up unilaterally.”

They continued, “Kim JunSu, Kim JaeJoong and Park YooChun has been following SM’s instruments from beginning of 2004 till now, going back and forth promoting in Korea, Japan, China etc, and in a year except for 1 week they get only 3-4 hours of sleep a day to do our schedule.”

Also, “In the process the health of the 3 members are very much deteriorated, they are also suffering from mental fatigue, and as time went SM continue to established on their own decision for Dong Bang Shin Ki to advance into other countries. In the end the 3 members felt that as compared to be fulfilling their dreams to be singers, they are used more as a tool by the compared to earn profits, and they wish to use each of the members to also go into other entertainers’ activities.”

The 3 members’ representative also added, “It is a 13 years contract but in reality it is a lifetime contract. With the exclusive rights clause in the contract, the 13 years also include the time the members are serving their military service, hence it will go for more than 15 years. And now it has not even been near to 10 years since the group’s debut, hence it seems like the contract will last until the members’ retirement from the entertainment zone. The penalty for retracting the exclusive right clause is 3 times the investment cost and 2 times the lost in earnings. They also asked about the penalty of cancelling the whole contract but it will involve several hundred billions KRW of penalty, hence in reality there is no way out but to be tied down to SM because of the contract.”

Also, “The members did not receive the right treatment even from SM. Without getting any contract fees, the initial contract was that if their album sells more than 500K copies, each member will get about 10 million KRW during the next album release. If they sell less than 500K copies of album, they will get nothing.”

The 3 members had went down to Seoul Central District Court to file for a retractile of their exclusive belonging rights with SM Entertainment on 31st July, causing an outrage of speculations about the group’s disbanding and also problems between the members and SM.
